Data protection notice

1. personal data

We (Rechtsanwaltskanzlei Mag. Jakob Weinrich, LL.M.) collect, process and use your personal data only with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this in compliance with the provisions of data protection and civil law.

We only collect personal data that is required for the performance and processing of our legal services or that you have voluntarily provided to us.

Personal data refers to any data that contains specific information about a person’s personal or factual circumstances, such as name, address, email address, phone number, date of birth, age, gender, Social Security number, video recordings, photos, voice recordings of individuals, and biometric data such as fingerprints. Sensitive data, such as health data or data related to criminal proceedings, may also be included. 

2. information and deletion

As a client or, more generally, as a data subject, you have the right - subject to the lawyer's duty of confidentiality - to obtain information at any time about your stored personal data, their origin and recipients and the purpose of the data processing, as well as the right to rectification, data transmission, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data.

If there are any changes to your personal data, please inform us accordingly.

You have the right at any time to revoke any consent given for the use of your personal data. Your request for information, deletion, rectification, objection and/or data transfer, in the latter case provided that it does not involve disproportionate effort, may be addressed to the address of the Law Firm indicated in point 10 of this statement.

If you believe that our processing of your personal data violates applicable data protection laws or that your data protection rights have been infringed upon in any other way, you have the option of filing a complaint with the competent supervisory authority. In Austria, the competent authority is the Data Protection Authority. 

3. data security

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation.

Notwithstanding efforts to maintain a reasonably high level of due diligence at all times, it cannot be excluded that information you disclose to us via the Internet may be viewed and used by others.

Please note that we therefore assume no liability whatsoever for the disclosure of information resulting from data transmission errors not caused by us and/or unauthorized access by third parties (e.g., hacking of email accounts or phones, interception of faxes). 

4. use of the data

We will not process the data provided to us for any purposes other than those covered by the engagement agreement, your consent, or any other provision in accordance with the GDPR. This does not apply to the use of such data for statistical purposes, provided that the data has been anonymized. 

5. transmission of data to third parties

In order to fulfill your order, it may also be necessary to forward your data to third parties (e.g. the other party, substitutes, insurance companies, service providers that we use and to whom we make data available, etc.), courts or authorities. Your data will only be forwarded on the basis of the GDPR, in particular for the fulfillment of your order or on the basis of your prior consent.

Furthermore, we inform you that in the course of our legal representation and support, we regularly obtain factual and case-related information from third parties.

Some of the recipients of your personal data listed above are located outside your country or process your personal data there. The level of data protection in other countries may not be equivalent to that in Austria. However, we only transfer your personal data to countries for which the European Commission has determined that they have an adequate level of data protection, or we implement measures to ensure that all recipients maintain an adequate level of data protection, for which purpose we enter into standard contractual clauses (2010/87/EC and/or 2004/915/EC). 

6. disclosure of data mishaps

We strive to ensure that data breaches are detected promptly and, where necessary, reported immediately to you or the relevant supervisory authority, including details of the specific categories of data affected. 

7. storage of the data

We will not retain data for longer than is necessary to fulfill our contractual or legal obligations and to defend against any potential liability claims. 

8. cookies

This website uses "cookies" to make our offer more user-friendly, effective and secure.

A "cookie" is a small text file that we transfer to the browser's cookie file on your computer's hard drive via our web server. This enables our website to recognize you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our web pages. The content of the cookies we use is limited to an identification number that no longer allows any personal reference to the user. The main purpose of a cookie is to recognize visitors to the website.

9. server log files

In order to optimize this website in terms of system performance, user-friendliness and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your internet protocol address (IP address), browser and language setting, operating system, referrer URL, your internet service provider and date/time.

This data is not combined with sources of personal data. We reserve the right to review this data at a later date if we become aware of specific indications of unlawful use.
